My sons and I would stop by this particular property quite often as is it son the way to and from school. We couldn't resist stopping to say hello to these guys!

Tenants- Know your rights! You have them- a lot of them! Arizona Landlord Tenant Act

I recently received a call from a friend who has been renting a condo for the past two years. She just renewed her lease at the beginning of February.

The other day she woke up to- you guessed it- a foreclosure sale notice taped to the door. She had no idea the condo was in foreclosure and contacted the landlord - who she now knows- is not the owner. This person, the acting landlord, told her that the owner is trying to sell it and that the new buyer will \"most likely\" honor her lease.

(By the way, if you do the math- you will see another \"ethics\" point in the renting of the property in February and the notice of sale coming out in March. That is a whole other blog topic!)

Within a few days, she starts getting calls from Realtors wanting to show the property. One calls and says- \"I would like to show the condo in 15 minutes\". Mind you, this is a Sunday morning around 8:30 am. The tenant had just stepped out of the shower and politely asked the Realtor to give her 30 minutes and that would be fine.  The Realtor was not happy about this and told her never mind as her clients were leaving town within the hour. Within a few minutes the tenant gets a call from the \"acting landlord\" - yelling at her and telling her that she can not refuse to let people in, that they need to sell the condo and she has to comply with the showings.

On another occasion, she had a Realtor just walk in, without even knocking! On yet another occasion, a potential buyer (no Realtor with her) knocked on the door saying that she was told she could just come over and look at the property. It is still unclear if she was told by the landlord or the Realtor but either way, so so wrong!

My friend called me, very upset. I informed her that she has rights. By law, she is to be given a 48 hour notice before anyone enters her condo. She had never heard of this. Not by her landlord, not by the listing agent.

I immediately sent her a copy of the Arizona Landlord/Tenant Act so that she knows her rights. I also referred her to an awesome attorney, Mark Winsor at Winsor Law Group, to get some advice on the situation.

I went into ARMLS to check the listing and this is what the listing agent had in the Realtor remarks \"Tenant occupied- call owner then show\". Nothing about a 48 hour notice, nothing about making sure that contact is made prior to entering. Call, then show- that's it.

I know we all hate to see \"48 hour notice to show- tenants rights\" when we are showing homes to buyers but keep in mind, everyone has rights. Rights that should be respected. It is our job as Real Estate Professionals to make all parties aware of these laws. They are in place for a reason.

If you have listings with tenants in place, make sure YOU know their rights and put measures in place so that those rights are protected. Talk to the tenants about showings and their rights.

New Bank Owned Homes on the Market in Arizona today! Arizona Bank Owned Homes for Sale!

Purchasing a bank owned home or a bank foreclosure is not much different than purchasing a home from a seller other than the seller is the bank and they like to change things up a bit.

\"Arizona

For example:

In the Arizona contract, the buyer has 10 days to inspect the property they are purchasing after their offer is accepted and they have opened escrow.Typically, not always, in a bank owned transaction, the bank likes to shorten that inspection period to 7 days and sometimes 5 days. This can be a little challenging but it can be done. You need to get your inspection scheduled right away! Most inspectors in this market will accommodate a short notice appointment to get your business.

The bank also likes to send back an addenduum once they accept your contract. Your contract acceptance is contingent upon you accepting the terms of the addendum. This addendum can be 2 pages to 20 pages long. Have your Realtor go over this addendum with you to make sure you understand what it means. This is not a document that you want to speed read! Make sure you know what you are agreeing to!

The bank likes to determine the close of escrow and will charge you a per diem fee if you do not close on the date that both parties have agreed to.I have seen this fee between $50 and $100 per day. They want to insure that you close when you say you will close. We have had transactions go beyond the close of escrow date and have had the per diem waived by the bank on several occasions but they do not have to waive it as it is in the addendum and they could enforce it if they wanted to.

There has been a lot of competition on bank owned homes recently.  Especially if the property is in a lower price range and priced aggressively, you will want to move quickly in preparing an offer. These homes typically go under contract in 3 to 5 days and sell over the list price. It is best to have all of your paperwork and pre-approvals in order before you find the home so that you are ready to go when one comes available in your price range.

Not all bank owned homes are trashed! There are a lot of bank owned homes in great condition! Some don't need any work at all, some need just paint and new carpet. There are some really bad ones out there, don't get me wrong! Some are missing everything from the AC unit to the toilet! There are good and bad- don't avoid them all together because you have heard that they are all distressed, gutted and nasty! We have sold some beautiful bank owned homes!

Arcadia Arizona - Do you know what season it is in Arcadia? It is winter grass planting season!

What does that mean to me, you ask? Well, it means that even though the heat is subsiding and cooler air awaits us when we step out of our front doors in the morning-  it also brings red itchy eyes, runny noses and lots of sneezing! If you are lucky enough that blowing dust and grass don't bother you- rejoice! The rest of us will not be having much fun for the next few weeks of scalping and planting!

Ok, how many of you have been driving down Goldwater in Scottsdale recently and have seen a pig standing on the side of the road holding a sign?

Yes! I said a pig holding a sign! This is BACON! A restaurant just North of Indian School Road on Goldwater Blvd.

My mom and I have been seeing this pig for over a year and finally decided to stop in and see what the \"Oink\" is all about.

We had breakfast. She had eggs over easy with, BACON, of course! It also came with sourdough toast and home fries.

I ordered an egg white omelet, mind you I have ALWAYS hated egg white omelets but am currently trying to lose some weight so decided to give it try. It had spinach and tomatoes. It normally comes with Feta but I had them hold the Feta.

It was delicious! The BEST omelet, egg white or regular, that I have ever had and the BACON was just the way I like it, crisp and delicious!

So, the next time you are driving around Arcadia or Old Town Scottsdale and you feel a little hungry or if you happen to see a rather tall Pink Pig standing along the road - Stop in and grab a bite! You won't regret it!

Purchasing a HUD home in Arizona-Arizona HUD Homes For Sale

Are you thinking about purchasing a HUD home in Arizona? There are many HUD homes for sale in the Phoenix area compared to a few years ago when there were less than a handful!

Some things you should know when wanting to bid on a HUD home:

  1. What is a HUD home? When someone with a Federal Housing Administration (FHA) insured mortgage can't meet the payments, the lender forecloses on the home; FHA pays the lender what is owed; and then the United States Department of Housing and Urban Development (HUD) takes ownership of the home. Then HUD sells it at market value as quickly as possible.
  2. You must submit your bid with an agent or broker who is registered with HUD.
  3. Anyone who can pay cash or qualify for a mortgage can buy a HUD home. (Proof of funds are required for cash and a copy of a loan approval or LSR is required if you are financing.)
  4. HUD homes are sold on their website at \"AS-IS\" fair market value. Fair market value is determined by a licensed FHA appraiser and that appraisal can be obtained by the buyer's lender if that buyer wins the bid.
  5. A buyer can offer more than the \"AS-IS\" price as long as they have the cash to cover the overage.
  6. HUD will not make any repairs to the property. Nor will the warranty the property. Purchasers are advised that there may be code and/or zoning violations on these properties and that it is the responsibility of the purchaser to identify these violations.
  7. HUD does an inspection on the homes at the time they list them. This inspection report is posted in the property listing on their site for everyone to see. Buyers are very strongly encouraged to have homes inspected by a qualified home inspection company themselves once their bid is accepted and not rely fully on the HUD inspection of the home.
  8. Access to the home-All purchasers MUST be accompanied by a broker or agent when viewing any HUD home listed for sale. Buyers may not enter a house without their broker/agent for any reason prior to closing, even for inspections. HUD registered agents have special keys to access these homes.
  9. Escrow funds- In a typical transaction, the agent would collect a check from their buyer at the time the offer was signed for the escrow deposit. HUD works a little differently. The buyer will obtain their Earnest Check by Certified Funds made payable to the buyer's name AND HUD immediately AFTER their offer is accepted by HUD. The agent then has to overnight the sales packet with that check so that HUD receives it within 48 hours.

All in all, HUD seems very complicated when you first look at it but if you have an agent with some experience, it can make the process much simpler.
